IMPORTANT RENTAL RISK NOTICE
• All hired items remain the property of Signature Event Hire at all times. A rental does not transfer ownership.
• From handover or delivery until the items are returned and checked, the customer is responsible for their safekeeping and proper use, subject to applicable law.
• Reasonable repair, cleaning or replacement costs may be charged for items that are lost, stolen, not returned or damaged beyond fair wear and tear.
• A refundable security deposit may be required. The deposit is security only and does not limit the customer’s liability if reasonable loss or damage exceeds the deposit.
• Higher-risk or higher-value rentals may require identity verification, proof of address, venue details and/or an increased security deposit before release.
SIGNATURE EVENT HIRE | CONSOLIDATED RENTAL TERMS & CONDITIONS
Signature Event Hire | www.signaturehire.co.za | orders@signaturehire.co.za
1. Application, acceptance and scope
These consolidated Terms & Conditions govern rentals placed through the Signature Event Hire website, online rental shop, quotation system, invoice or other written booking channel. They incorporate the booking, deposit and breakage, delivery and collection, cancellation and refund, return and related rental policies into one document.
By placing an order and ticking the acceptance box at checkout, or by signing or accepting a quotation or hire agreement, the customer confirms that they had a reasonable opportunity to read these Terms before concluding the booking.
Electronic acceptance, electronic communications and automated online transactions may be used to conclude the rental agreement in accordance with applicable South African law. If a customer contracts for a company or other organisation, the person placing the order warrants that they are authorised to bind that entity.
1.1 Definitions
In these Terms, “we”, “us”, “our” and “Signature Event Hire” mean Signature Events Hire (Pty) Ltd trading as Signature Event Hire; “customer”, “hirer”, “you” and “your” mean the person or entity placing the booking; “items” means any furniture, tableware, glassware, catering items, audio or lighting equipment, safety equipment, accessories, packaging, crates or other goods supplied on hire; “hire period” means the agreed period shown in the order confirmation; and “replacement value” means the reasonable cost of replacing an item with the same or a reasonably comparable item at the time of loss.
2. Bookings, availability and confirmation
• Website availability is intended to be accurate but remains subject to final system verification.
• A quotation, enquiry or online cart does not reserve stock unless we confirm otherwise in writing.
• A booking is confirmed once the required hire charges have been paid in full, or once we have accepted a different written payment arrangement.
• Confirmed items are reserved for the dates shown on the order confirmation.
• The customer is responsible for checking item descriptions, quantities, dates, collection or delivery details and contact information before confirming the order.
• Changes requested after confirmation are subject to stock availability and may change the total amount payable.
3. Prices, payment and security deposits
Rental charges, delivery and collection charges, deposits and any other agreed fees will be shown at checkout, on the quotation or invoice. Amounts are payable in South African Rand. VAT will be shown where applicable.
Unless otherwise agreed in writing, the rental charge and any required security deposit must be paid before items are released. A payment screenshot is not accepted as proof that cleared funds have been received.
3.1 Deposit & Breakage Policy
A refundable security/breakage deposit may be required depending on the order value, item type, risk profile or equipment hired. The security deposit is separate from the hire charge and is not part-payment for the rental.
• Returned items are counted, tested where appropriate and inspected after receipt.
• Where everything is returned on time and in acceptable condition, the refundable deposit balance will be processed after reconciliation.
• Reasonable deductions may be made for missing items, breakage, damage beyond normal wear and tear, excessive cleaning, unpaid late fees, replacement costs, repair costs or other valid booking charges.
• Where a deduction is made, we will provide a reasonable explanation or supporting record.
• A security deposit does not limit the customer’s liability. If reasonable repair, replacement or other lawful charges exceed the deposit, the balance remains payable.
Any remaining deposit balance will normally be submitted for refund within 5 business days after the return inspection and reconciliation, subject to banking or payment-gateway processing times.
4. Hire period and late returns
The hire period begins and ends at the dates and times shown on the booking confirmation. Any extension must be approved in writing before the agreed return time. Continued possession after expiry of the hire period does not transfer ownership and does not create a new rental unless an extension is agreed.
Late returns can affect another customer’s booking. Where items are returned late without an approved extension, reasonable additional hire or late fees and reasonable direct costs caused by the delay may be charged to the extent permitted by law.
5. Identity, fraud prevention and release of goods
To reduce fraud and protect rental stock, we may require reasonable verification before releasing items, particularly for first-time customers, high-value electronics, PA/audio equipment, AEDs or unusual/high-risk bookings.
• Verification may include a valid South African identity document or passport, proof of address, company registration information, payment verification, event or venue information and authorised-collector details.
• We may decline or pause a booking if reasonably required verification cannot be completed or if information is materially inconsistent.
• We may withhold release of goods where payment cannot be verified or where required verification has not been completed.
6. Ownership of hired items
All hired items remain the sole property of Signature Event Hire or the relevant owner/supplier at all times. Nothing in the rental agreement transfers ownership or any security interest to the customer.
The customer may not sell, pledge, pawn, encumber, dispose of, permanently alter, lend, sub-hire or transfer possession of the items to another person without our prior written consent.
7. Delivery, Collection & Shipping Policy
7.1 Service area
We primarily serve the Helderberg and surrounding Western Cape areas, including Somerset West, Strand, Gordon’s Bay and selected surrounding locations. Deliveries to Stellenbosch, the Winelands, Cape Town, Overberg or other areas may be available by prior arrangement and subject to quotation.
7.2 Delivery charges
• Delivery is quoted separately unless the order specifically states that delivery is included.
• The delivery fee may depend on distance, order size, vehicle requirements, access restrictions, timing, staffing and whether multiple trips are required.
• A delivery quote covers the agreed delivery service only and does not automatically include setup, styling, placement, installation or breakdown unless these services are expressly listed on the booking.
7.3 Delivery dates and time windows
We will agree a delivery date and, where possible, a delivery window. Event logistics can be affected by traffic, venue access, loading restrictions and earlier deliveries. We will make reasonable efforts to meet the agreed timing and will communicate material delays as soon as reasonably possible.
7.4 Venue access and customer responsibilities
• The customer must provide accurate venue details, access instructions and a contact person who is available at the agreed handover time.
• The customer must disclose stairs, lifts, long carry distances, restricted vehicle access, security procedures, loading permits or other conditions that may affect delivery.
• Additional charges may apply where undisclosed access conditions materially increase the time, labour or vehicle requirements.
• A safe and reasonably accessible handover area must be available.
7.5 Customer collection
Customer collection may be available by arrangement. Collection times must be booked in advance. The person collecting should have the order details and may be required to provide identification or authorised-collector confirmation for highervalue bookings.
• The customer is responsible for using a suitable vehicle and safely securing items in transit.
• We may decline to release items if the vehicle or loading arrangement presents a clear risk of damage or unsafe transport.
• Items are considered handed over once they have been checked and released to the customer or authorised collector.
7.6 Setup and placement
Standard delivery means delivery to the agreed accessible handover area. Unless setup or placement is expressly included in the booking, the customer remains responsible for arranging tables, chairs, tableware, equipment and other items at the venue.
7.7 Return of hire items
• Items must be ready for collection or returned by the agreed date and time.
• Food, liquids, waste and personal items should be removed before return.
• Items should be repacked in the crates, boxes, racks or containers supplied wherever applicable.
• Late or incomplete returns may result in additional hire, collection or replacement charges.
7.8 Failed delivery or collection
If delivery or collection cannot be completed because the venue is inaccessible, no authorised person is present, information supplied is incorrect, or access is materially different from what was disclosed, a redelivery or additional collection fee may apply. Any such charge will be reasonable in the circumstances.
7.9 Outdoor use and weather
Items approved for outdoor use must still be protected from unsafe weather conditions. Electrical, sound and lighting equipment must not be exposed to rain or moisture. Gazebos and similar temporary structures must be properly secured and must not be used in unsafe wind or severe weather conditions.
7.10 Courier and national shipping
Signature Event Hire is primarily a local rental business and does not routinely courier general hire stock nationally. If a specific item is eligible for courier or third-party transport, the arrangements, costs, risk allocation and return requirements will be confirmed separately in writing before dispatch.
7.11 Damage in transit
Where we provide delivery, we remain responsible for the items until handover to the customer or venue representative. Where the customer collects or arranges a third-party carrier, responsibility transfers at handover, subject to rights that cannot lawfully be excluded.
8. Inspection and acceptance of items
• The customer should inspect the order at collection or delivery and notify us promptly of shortages, visible damage or incorrect items.
• Where reasonably possible, we will correct verified shortages or supply a suitable alternative.
• Photographs, serial numbers, barcodes, packing lists and condition records may be used to document handover and return condition.
9. Care, permitted use and safety
• The customer is responsible for the reasonable care, security and proper use of the items from handover until they are returned to and accepted by us.
• Items must be used only for their intended purpose and in accordance with any safety or operating instructions supplied.
• The customer must protect items from avoidable theft, rain, fire, excessive heat, misuse, vandalism and unauthorised modification.
• Electrical, sound, lighting, first-aid and specialist equipment must be kept dry, secure and protected from misuse, weather and unauthorised interference.
• Audio/electrical equipment must be operated by a competent adult, connected to a suitable and safe power supply, and must not be opened, rewired, modified or repaired by the customer.
• Unless expressly agreed, our rental of equipment does not include an operator, technician, event planner or décor/styling service.
10. Cleaning and return condition
Standard cleaning is included only where stated. Customers are still required to remove food, liquids, waste and personal items and to repack goods reasonably in the containers supplied.
Additional charges may apply for excessive soiling, wax, glue or adhesive residue, paint, heavy staining, food left to spoil, smoke or fire residue, misuse or cleaning beyond normal event use.
11. Loss, theft, breakage and damage
The customer must notify us as soon as reasonably possible of any loss, theft, breakage or damage.
• Fair wear and tear from ordinary proper use is not chargeable.
• Reasonable repair costs or replacement value may be charged for items lost, destroyed, stolen, irreparably damaged or damaged through misuse, negligence, avoidable breakage or unauthorised alteration.
• Items must be returned with all accessories, cables, stands, batteries where reusable, cases, crates and other components supplied. Missing components may be charged at reasonable replacement cost.
• If an item is stolen, we may require a SAPS case number or other supporting information.
• If an item is not returned after reasonable contact and lawful demand, we may suspend the customer account, continue reasonable hire/late charges where permitted, recover reasonable replacement loss and pursue lawful civil recovery. Where the facts reasonably suggest theft, fraud or unlawful retention, the matter may be reported to SAPS.
12. Cancellation & Refund Policy
12.1 Customer cancellations
Cancellations must be submitted in writing so that the date of notice can be recorded. In accordance with applicable South African consumer law, a reasonable cancellation charge may apply to advance bookings. The cancellation charge is not automatically the full amount paid.
When determining a reasonable cancellation charge, relevant factors may include:
• the nature and value of the items or services reserved;
• the amount of notice given before the hire date;
• work already performed or costs reasonably incurred for the booking;
• our reasonable opportunity to re-hire the reserved stock to another customer; and
• general practice in the event-hire industry.
After any reasonable cancellation charge and other amounts lawfully due have been deducted, the remaining balance will be refunded to the customer.
12.2 Death or hospitalisation
Where section 17 of the Consumer Protection Act applies because the booking cannot be honoured due to the death or hospitalisation of the person for whose benefit the booking was made, we will not impose a cancellation fee. We may request reasonable supporting information where necessary to process the cancellation.
12.3 Cancellations or non-supply by Signature Event Hire
If we cannot supply a confirmed item or service because of loss, damage, breakdown, stock error or another event outside our reasonable control, we will contact the customer as soon as reasonably possible and may offer a comparable substitute. If the customer does not accept the substitute, or no reasonable substitute is available, the amount paid for the affected item or service will be refunded. This does not affect any non-excludable consumer rights.
12.4 No automatic refund after use
Once hire items have been collected or delivered and the agreed hire period has commenced, a refund is not automatically due because items were unused, the event changed, attendance was lower than expected, or the customer no longer required part of the order. Any refund request will be considered according to the circumstances and applicable law.
12.5 Incorrect, missing or faulty items
Customers should notify us promptly if an item is missing, materially incorrect or not functioning as reasonably expected. We will assess the issue and, where appropriate, may replace the item, provide a suitable alternative, repair the issue, or refund the affected hire charge. The available remedy will depend on the circumstances and applicable consumer law.
12.6 Refund processing
Approved refunds are normally submitted for processing within 5-7 business days after the amount has been confirmed and, where relevant, returned items have been inspected. Payment processors and banks may take additional time to reflect the credit. Where possible, refunds will be made to the original payment method or bank account used for the transaction.
12.7 Non-refundable third-party costs
Where a booking includes a third-party cost that has already been irreversibly incurred specifically for the customer, that cost may be taken into account when calculating a reasonable cancellation charge, subject to applicable law and the circumstances of the booking.
12.8 How to request a cancellation or refund
1. Email orders@signaturehire.co.za with your name and order number.
2. State whether you are requesting a cancellation, deposit refund or another refund.
3. Provide the reason and any relevant supporting information.
4. We will review the request and confirm the amount, any applicable deductions and the refund method.
13. Changes to orders and rescheduling
Changes are subject to availability. Adding items may require additional payment and deposit. Reducing quantities after confirmation may be subject to the same reasonable cancellation principles because stock may already have been reserved and unavailable to other customers.
Requests to reschedule are subject to stock availability and may be treated as a cancellation and new booking where the dates materially change. No change is binding until confirmed by Signature Event Hire in writing or reflected in an updated order confirmation.
14. Return inspection and completion of the rental
Return of goods does not automatically mean the order is fully closed. We may reasonably count, test and inspect returned items after receipt. The order is complete once the items have been reconciled and any missing or damaged-item issue has been resolved.
For electronic equipment, a functional test may be performed after return. If a problem is found, we will record the issue and, where reasonably practicable, provide photographs, test results, repair quotations or other support for any charge.
15. Customer responsibility for venue and event conditions
Unless we expressly agree otherwise, the customer is responsible for obtaining venue permission, electrical access, weather protection, security and any permit or approval required for the event. The customer must ensure that rented items can be safely placed and used at the venue.
We may refuse to place or leave equipment in a location that our staff reasonably consider unsafe, inaccessible or likely to cause damage, after discussing a reasonable alternative with the customer.
16. Our responsibility and limits permitted by law
We will use reasonable care in preparing and supplying rental items and will not exclude or limit any liability or consumer right that cannot lawfully be excluded or limited under South African law.
To the extent permitted by law, we are not responsible for loss arising solely from the customer’s misuse, failure to follow instructions, unsafe venue conditions, unauthorised modifications, use outside an item’s intended purpose, or the acts of third parties outside our reasonable control.
Event plans should not depend on a single item where failure would create a critical safety risk. If equipment develops a fault during the hire period, the customer must stop using it if continued use may be unsafe and contact us promptly so that reasonable assistance, replacement or other remedy can be considered.
17. Force majeure and circumstances beyond reasonable control
Neither party will be treated as having breached the agreement to the extent performance is prevented by circumstances genuinely beyond that party’s reasonable control, such as severe weather, fire, flood, civil unrest, road closure, widespread utility failure or another comparable event. The affected party must notify the other as soon as reasonably possible and take reasonable steps to reduce the impact.
This clause does not remove rights that a consumer has under applicable law, including rights relating to non-supply or refunds where those rights apply.
18. Privacy, POPIA and personal information
We may collect and process personal information reasonably necessary to quote, book, deliver, verify identity, prevent fraud, take payment, communicate with the customer, maintain rental records, recover property or money lawfully due, comply with tax or legal obligations and protect legitimate business interests.
Personal information will be processed in accordance with the Protection of Personal Information Act 4 of 2013 (POPIA) and the Signature Event Hire Privacy Notice/Privacy Policy. Personal information should be kept only for as long as reasonably required for lawful purposes and protected by appropriate organisational and technical measures.
Where Rentflo or another service provider processes customer information on our behalf, that processing remains subject to applicable data-protection obligations and the relevant service-provider arrangements.
Note: this consolidated rental document contains the rental privacy terms, but it does not replace the separate detailed Privacy Notice/Privacy Policy where that notice is published on the website.
19. Electronic communications
The customer agrees that order confirmations, invoices, collection or delivery information, return reminders, notices and other rental communications may be sent electronically to the email address or mobile number supplied. The customer is responsible for keeping those details accurate.
A communication is not invalid merely because it is electronic. Customers should retain their order confirmation and these Terms for their records.
20. Website information, images and system errors
Product photographs are illustrative and minor differences in colour, finish, dimensions or normal wear may occur between units. We aim to describe items accurately and will correct material errors when identified.
If a clear pricing, stock or system error occurs, we may contact the customer before fulfilment to correct the error. We will not unilaterally increase an already confirmed price without the customer’s agreement except where required by law or where the customer changes the order.
21. Refusal or cancellation for fraud, safety or material breach
We may refuse to release items, suspend an order or cancel a booking where there are reasonable grounds to believe payment is fraudulent, identity information is materially false, the proposed use is unlawful or unsafe, the customer has materially breached a prior rental, or releasing the goods would create a serious and unreasonable risk to our property or staff.
Where we cancel for reasons not caused by the customer and no substitute is accepted, amounts paid for undelivered rental items will be refunded as required by law. Where cancellation results from the customer’s material breach or fraud, lawful recovery rights are reserved.
22. Complaints, disputes and governing law
Please contact Signature Events Hire (Pty) Ltd first so that we can attempt to resolve any complaint promptly and fairly. Nothing in these Terms prevents a consumer from using any remedy or complaint process available under the Consumer Protection Act or other applicable South African law.
These Terms are governed by the laws of the Republic of South Africa. Subject to any consumer rights relating to jurisdiction, the parties may approach a court or other competent forum with jurisdiction over the dispute.
23. General
If any provision of these Terms is found to be unlawful or unenforceable, the remaining provisions continue to apply to the extent permitted by law. A failure by either party to enforce a right immediately does not automatically waive that right.
The order confirmation, accepted quotation (if any), these Terms, any signed handover or return record and the Privacy Notice together form the rental agreement. If there is a conflict, a specifically agreed written term on the customer’s order or quotation prevails for that booking, but only to the extent of the conflict.
We may update these Terms for future bookings. The version accepted when an order is placed will govern that order unless a lawful written variation is agreed.
